WAIVER OF LIABILITY AND ASSUMPTION OF RISK

I, the undersigned, on behalf of myself and my heirs and assigns, hereby acknowledge that I have voluntarily applied to enter and engage in and/or observe activities at Corsair Tactical Solutions, LLC ("Corsair Tactical Solutions"). These activities include, but are not limited to, the use and handling of equipment provided either by myself or by Corsair Tactical Solutions, and the services and training provided by employees or contractors of Corsair Tactical Solutions.

I acknowledge that access to the facilities of Corsair Tactical Solutions has value to me and others. In granting me access, Corsair Tactical Solutions may necessarily deny access to another qualified person. As consideration for being granted such access, I agree to the terms of this Waiver of Liability and Assumption of Risk and agree to abide by all rules and conditions, including adhering to the Four Fundamental Rules of Safety, which I confirm I am well-informed of and fully knowledgeable about.

I acknowledge and understand that activities at Corsair Tactical Solutions are inherently hazardous and may involve both known and unanticipated risks, which could result in damage or destruction of property and physical or emotional injury, including paralysis or death. These risks include, but are not limited to:

• Injury to myself or others;

• Partial or total loss of eyesight or hearing;

• Inhalation or other harmful contact with contaminants;

• Being struck by flying or falling objects;

• Equipment malfunctions or failures.

I further acknowledge that Corsair Tactical Solutions’ facilities contain mechanical devices and equipment that are designed for training purposes but may not always function perfectly, which could lead to unexpected failures.

I acknowledge that Corsair Tactical Solutions makes no warranties regarding the design, manufacture, condition, or fitness of its facilities or equipment, including but not limited to protective gear, training equipment, and first-aid supplies. Additionally:

• I represent that I am experienced and skilled in the proper handling and use of all equipment I intend to use at the facility unless I specifically inform Corsair Tactical Solutions staff otherwise at check-in.

• I have never been convicted of a felony or a crime of domestic violence in any jurisdiction.

• I am not a habitual user of alcohol, nor am I an illegal user of any controlled substance.

As lawful consideration for being permitted by Corsair Tactical Solutions to enter and use its facilities or equipment and to engage in or observe activities, I agree as follows:

1. Assumption of Risk

   • I voluntarily assume full responsibility for any and all risks, injuries, or damages, known or unknown, which I might incur as a result of entering and using Corsair Tactical Solutions’ facilities or equipment, including death.

2. Agreement to Abide by Rules

   • I agree to abide by Corsair Tactical Solutions’ Code of Conduct / Safety Rules, both now and as modified in the future.

3. Waiver and Release of Claims

   • I, my next of kin, heirs, guardians, representatives, assigns, or any other person claiming under me, hereby waive any and all claims against Corsair Tactical Solutions, its agents, officers, members, employees, instructors, volunteers, or representatives, arising from injuries or damages sustained as a result of my participation at the facility, including death.

   • I forever release, waive, discharge, and covenant not to sue Corsair Tactical Solutions for any personal injury, death, disability, property damage, theft, or any other acts or omissions, including those caused by negligence.

4. Binding Agreement

   • I acknowledge that this agreement, including any written amendments or modifications, shall remain in full force and effect for all future visits.

   • I agree that any disputes shall be subject to binding arbitration in the state of Texas.

5. Severability Clause

   • If any provision of this Waiver is found to be invalid or unenforceable, the remainder shall continue in full force and effect.

6. Acknowledgment of Understanding

   • I have carefully read this Waiver of Liability and Assumption of Risk, fully understand its contents, and sign voluntarily of my own free will.

   • No other inducement, assurance, or guarantee has been made to me in consideration of my signing this Waiver.

   • This Waiver may be amended or modified only by a written agreement signed by me and an authorized agent of Corsair Tactical Solutions.
